General terms and conditions

1. Scope

These General Terms and Conditions apply to quotations, deliveries and services provided by Schmiede & Metallbau Schrader, Jan-Philipp Schrader, Harderkamp 4a, 24620 Bönebüttel, Germany, unless otherwise agreed in writing in an individual case.

2. Quotations and conclusion of contract

The presentation of services on this website does not constitute a binding offer. A contract is concluded only when an individual quotation has been prepared and accepted by the customer, or when another express order is confirmed.

3. Project documents and cooperation

Customers shall provide the information, drawings, models, dimensions, photos, load assumptions, quantities and other specifications required for project review as completely as possible. Changes, unclear details or missing information may affect costs, schedules and execution.

4. Prices, payments and advance payments

Prices are set out in the relevant quotation. An advance payment may be agreed for custom-made products, special designs, material procurement or extensive planning. Invoices are payable within the period stated in the quotation or invoice.

5. Manufacturing, delivery and assembly

Manufacturing, delivery and assembly schedules are agreed for each project. Dates may be postponed if technical clarifications, approvals, material availability, on-site prerequisites or information to be supplied by the customer remain outstanding.

6. Retention of title

Delivered goods and manufactured items remain the property of the contractor until full payment has been received, insofar as legally permissible.

7. Warranty and defects

Statutory warranty rights apply unless otherwise validly agreed in an individual case. Obvious defects should be reported as soon as reasonably possible after receipt of the goods or services, together with a comprehensible description.

8. Liability

Liability for damage arising from injury to life, limb or health, and for intent and gross negligence, is governed by statutory provisions. In all other respects, liability is governed by statutory provisions and the contractual terms agreed in the individual case.

9. Final provisions

German law applies. If individual provisions are invalid, the validity of the remaining provisions remains unaffected. A place of jurisdiction may be agreed in individual cases for business customers.
